Making a car insurance claim - getting a replacement car

Getting a replacement car following an accident that was someone else’s fault
If you have been involved in a car insurance accident that wasn’t your fault, Hoot legal expenses insurance may be able to arrange a replacement car for you to use whilst yours is off the road.

All you will need to do is provide us with the date, time and place of the car accident and a description of how the accident happened. We will also need the name, address, registration number and insurance company of the person who you believe was responsible for causing the car accident.

We will then liaise with the insurance company of the person who was responsible for the car accident and provided they have admitted liability for the accident, we will arrange for a replacement car to be delivered to you (at a convenient time). The replacement car will be equivalent to your own, will be fully insured, and will be paid for by the insurance company of the person who caused the accident.

Even if you don’t have the full details of the person who caused the accident, we may still be able to help. We may be able to trace the other person, through the police (if they attended the scene of the accident) or the DVLA database. Failing that, we may be able to pursue a car insurance claim through the Motor Insurers’ Bureau (MIB), an organisation funded by the insurance industry to assist people who have been involved in a car accident with untraced or uninsured drivers.

Getting a replacement car following a fault accident
If you are involved in a car insurance accident which was your fault, you may be entitled to a free replacement car whilst yours is off the road or being repaired, under the terms of your comprehensive car insurance policy.

Even if you are not automatically entitled to a replacement car, one may still be available from the body shop whilst yours is being repaired (subject to their availability).

*A replacement car can usually be arranged under any of the following conditions:

1.Non fault accident – where we have the name, car registration number and insurance details of the person who caused the accident, we will supply a replacement car on a credit hire basis. This means the charges for this service will be passed onto the insurance company of the person who was responsible for the accident. This service may not be available where we are unable to get an admission of liability from their insurance company, or wherethe driver is unknown or uninsured.

2.If you have comprehensive insurance, a replacement car may be available under the terms of your insurance policy. Please check your policy details for more information.

3.The repairing garage may be able to provide a replacement car. This is subject to availability.
