Making a car insurance claim for personal injury compensation

Legal expenses insurance can prove vital if you’re involved in a car accident that wasn’t your fault and need to make a car insurance claim or personal injury compensation claim.

If you’re injured in a car accident that was not your fault this is what you can expect from your Hoot legal expenses insurance policy.

  • Once you have informed us of your accident, our solicitors will begin to put together your car insurance claim for your personal injury compensation against the other person, based upon the information you provide us.

  • A ‘Letter of Claim’ will be sent to the other person’s car insurance company, giving notice that you intend to pursue a claim against them for injury and/or uninsured losses caused in a car accident due to their insured’s negligence.

  • Evidence to support your claim will be prepared: including witness statements, police reports, vehicle engineer’s reports and other information relevant to the car accident, which will later be used as evidence to support your car insurance claim.

  • Our solicitor will ask you to complete a Claim Questionnaire, covering every aspect of your car insurance claim, to ensure you receive personal injury compensation for everything you are entitled to.

  • If you are injured, our solicitor will arrange for you to see an independent medical expert. The purpose of this report is to provide independent evidence to support your car insurance claim and help our solicitors put a realistic figure on the amount of compensation to be claimed.

  • Once all the information required to support your car insurance claim has been gathered, a ‘Schedule of Losses’ will be drawn up which lists everything you are claiming for. This will be sent to the other person’s insurance company, with a request for the claim to be settled.

The ‘Schedule of Losses’ may include:

  • Pain, suffering and loss of amenity (ability to carry out your usual day to day activities)

  • Cost of medication and prescriptions

  • Damage to personal effects

  • Loss of earnings

  • Other expenses

The majority of personal injury compensation claims are settled without the need to go to court.

*A replacement car can usually be arranged under any of the following conditions:

1.Non fault accident – where we have the name, car registration number and insurance details of the person who caused the accident, we will supply a replacement car on a credit hire basis. This means the charges for this service will be passed onto the insurance company of the person who was responsible for the accident. This service may not be available where we are unable to get an admission of liability from their insurance company, or wherethe driver is unknown or uninsured.

2.If you have comprehensive insurance, a replacement car may be available under the terms of your insurance policy. Please check your policy details for more information.

3.The repairing garage may be able to provide a replacement car. This is subject to availability.
