Advice on unlawful council parking and traffic finesLeading online car insurance company, Hoot, is alarmed to discover the extent of unlawful traffic and parking fines that have been levied against unsuspecting motorists nationwide. Councillors from various local government authorities have admitted receiving hundreds of thousands of pounds in fines, with a continuation of ticketing and fining even after particular road restrictions were found to be unlawful. In a BBC report, it has been stated that road markings and certain traffic restrictions have been found to be incorrect or incomplete, therefore negating their lawfulness. However, local authorities have continued to enforce restrictions, persistently issuing fines and receiving unlawful funds. A barrister looking into the issue said, "It's definitely a massive problem, definitely on a national scale, and we're talking about councils making tens of millions of pounds. "From a legal point of view, the term is unjust enrichment. And if the council unjustly enriches itself, it's got to pay the money back." A London councils' spokesperson seemed to argue it was ok to apparently steal public money, claiming it would not be in the public interest to pay the money back. He said, "Where there's only a technical error, a small issue, where no-one was genuinely misled, the council can take the view, is it really a good use of public money to repay the penalty?" Top car insurance company, Hoot, offers this guidance to motorists: check the circumstances of your traffic fine carefully before you pay. If you feel the road markings or signage is incomplete or inconclusive, take pictures to back up your argument, report your concerns as soon as possible.
